GENERAL TERMS AND CONDITIONS


1. General

The terms and conditions below in their version valid at the time of the order apply to the sales and shipping of goods, which the orderer has ordered through the internet at www.panamahatcollection.com or as Panamahatcollection purchase order. As the items are individually manufactured, unique pieces, there may be deviations from the pictures in individual cases. Differing terms and conditions of the orderer are not recognized, except if Panamahatcollection has expressly accepted these in writing.

2. Offer and closing of the contract

The Panamahatcollection offers are subject to change and non-binding. The sales contract for the goods chosen by you is only considered concluded, after Panamahatcollection has accepted your order by sending a message confirming the shipping of the goods.

3. Reservation of availability

The order confirmations are always sent subject to availability. The products for sale are generally manufactured as limited editions. It may happen that a product is not available any more at the time of the order. The orderer will be notified immediately.

4. Shipping

All orders will be sent by DHL-Express shipping. We dispatch all orders with registration and insurance.

5. Payment terms

The following methods of payment are possible:
Prepayment (bank transfer or Paypal)

If you want to pay by bank transfer you will receive an order confirmation from us including the details of our bank account. The ordered items will be shipped as soon as the amount has been received on the Panamahatcollection account. You can use PayPal to pay your invoice. The amount will be charged directly to your account, and you will be sent an order confirmation by email. Fees, taxes and costs related to the contract of sale shall be borne by the customer.

6. Right of revocation

Within 14 days you may revoke your order in writing without giving a reason by eMail or by returning the goods. The period starts at the earliest with the receipt of the goods and this instruction. In order to observe the revocation period, the timely returning goods or the sending of the revocation is sufficient. The revocation is to be sent to

Customized special productions are excluded from conversion/return.
 

In case of an effective revocation, the payments or goods received have be to returned by both parties. If you cannot guarantee a return of the goods received in total or if you can only guarantee it in part or only in a deteriorated state, you will have to pay compensation for the loss in value. In the case of a revocation, you as the orderer, are obligated to return the goods with sufficient postage and insured to Panamahatcollection. The value of the returned goods is refunded. The customer shall bear any and all expenses resulting from incorrect, incomplete or unclear information provided by the customer. In case a customer rejects acceptance of a product, said customer shall bear any and all costs of (return) transportation and storage.

7. Retention of title

The goods delivered remain the property of Panamahatcollection up to the complete payment of the purchase price.

8. Transport damages / defects

You, as the customer, are obligated to examine the goods immediately at delivery both for damages and for obvious defects. Possible damages have to be indicated to the deliverer immediately and be noted on the shipping documents. Furthermore, defects and transport damages are to be indicated in writing to Panamahatcollection within 7 working-days after the delivery of the goods.  The hat boxes of balsa wood are free packaging material when ordering an Ultrafino and do not have any separate, intrinsic value. Hat boxes that have been damaged during shipping, cannot therefore form the basic of a claim for damages. The customer's right of replacement not available for these boxes.

9. Data protection

The customer agrees that all personal data contained in the order and the contract of sale can be stored and processed electronically by Panamahatcollection in fulfilling such agreement. Panamahatcollection shall respect the customer’s privacy and shall strictly adhere to any and all applicable privacy regulations. Personal data shall be used only within the framework provided by law. All employees of Panamahatcollection are subject to the Panamahatcollection shall not pass on any customer data to third parties without the customer’s express consent. This shall not apply if there is a legal obligation to disclose data.
